Terms and conditions
Visiting, using and purchasing products from the website www.brotorheads.com/shop/, implies the full acceptance, each time you access our website, of the Terms and Conditions under which these products are provided. Brotorheads represents the company under which our products are marketed by the company BROTORHEADS S.R.L., hereinafter referred to as BROTORHEADS.
I. Definitions and terms
• Customer/Consumer – natural/legal person who places an Order;
• Seller – Brotorheads;
• Order – an electronic document that acts as a form of communication between the Customer and the Seller, through which the Customer transmits to the Seller his intention to purchase the products presented on the website;
• Products – any product, including the documents mentioned in the Order, which are to be provided to the Customer by the Seller;
• The Brotorheads store is located in the municipality of Bucharest, Romania;
• Contract / Terms and Conditions – an Order launched by the Customer and confirmed by the Seller;
1.1. The Customer accepts the terms in which the contract is concluded at the time of launching the order. The contract may be withdrawn in accordance with the legal provisions for distance contracts.
1.2. Brotorheads grants the consumer a legal guarantee of conformity according to the provisions of GEO 140/2021 on certain aspects relating to contracts for the sale of goods and with those of OG 21/1992 on consumer protection.
1.3. Access to the site. Brotorheads guarantees the user limited access, in personal interest, to this site and does not grant him the right to download or modify the site in part or in full, to reproduce the site in part or in full, to copy, sell/resell or exploit the site in any other manner, for commercial purposes or contrary to the interests of Brotorheads, without its written consent. Brotorheads has the right (but not the obligation) to delete any such content identified on the site. Brotorheads will not be responsible and will not be liable for any damages of any kind caused by such communications.
1.4. Information security. Brotorheads uses security measures against the loss, alteration or misuse of information that is under our control. Brotorheads does not assume responsibility for information loss caused by errors in the software with which the site is designed and hosted. We are also not responsible for errors in the security of the server that hosts the site.
1.5. Brotorheads has resale contracts (re-seller) with important representatives of the products present in our store. About the quality of the products, about the authenticity of the brand and about any other questions regarding a specific brand or a specific product, the customer can contact the representative of the respective brand or the importer in Romania.
1.6. The content of the site (texts, product descriptions, technical characteristics, images, symbols) has been compiled in close collaboration with the suppliers of the products presented. For this reason, Brotorheads does not assume responsibility for the descriptions of the products presented in our store, which are identical to those made available to us by the suppliers of each brand. Also, the images are presented on the site as an example, and the products actually delivered may differ from the images in any way (color, accessories, appearance, etc.). Brotorheads understands the importance of the information presented on this page and makes constant efforts to keep it updated. The only situation in which the information presented may differ from that of the product is when the manufacturer makes changes to its specifications, without informing us in advance.
1.7. Brotorheads cannot guarantee the availability of all products displayed in stock. For this reason, Brotorheads assumes the right not to honor a specific order if the respective product disappears from the supplier's current offer.
1.8. Products on the website www.brotorheads.com/shop/ may have several statuses, depending on the availability of the product, which we have listed below:
1.8.1. Available in Store - the product is in the Store's stock and can be shipped within one business day, if the order contains only products with this status;
1.8.2. Available - the product is in the warehouse or local supplier's stock and can be shipped by courier within a minimum of 2 business days from placing the order. In some cases, products marked this way can be shipped within a maximum of 3 business days;
1.8.3. On order (7 days) - the product is in the suppliers' stock and is only brought upon order. It takes a minimum of 2 business days, a maximum of 7 business days to ship an order containing at least one such product;
1.8.4. On order (30 days) - the product is in stock with external suppliers and is only delivered on order. It takes a minimum of 10 working days, a maximum of 30 working days to ship an order containing at least one such product. We recommend contacting by phone, whatsapp chat, or e-mail, before placing an order.
1.9. Orders containing products with multiple statuses will be shipped once all products have arrived in the Store and we can group them in full. Brotorheads does not deliver products in installments, except when the Customer requests this in writing, and undertakes to cover the additional costs generated by carriers.
1.10. The maximum value of Brotorheads' obligations to any customer in the event of non-delivery or improper delivery is the amount of the amounts collected by Brotorheads from this customer.
II. Price and payment methods
II.1. All sales prices of products displayed on www.brotorheads.com/shop/ are expressed in RON, EUR, or USD, and include VAT, except when selecting a country for which VAT does not apply in Romania, for example non-EU countries. Brotorheads may periodically offer promotions and discounts for the displayed products. These will be visible both in the product description, in the shopping cart, and on the invoice.
II.2. We reserve the right to change prices without prior notice, without affecting orders that have been placed up to the time of the price change.
II.3. In the Online Store, products can be paid for by bank transfer, or online with a bank card (Visa, Mastercard, Visa Electron, Maestro).
II.4. In the case of online payments, Brotorheads will issue a proforma invoice that will be sent to the Customer's email address, after an operator checks the compatibility of the order with the specified car model, as well as the availability of the products in the order. The proforma invoice can be paid by bank transfer or you can use the button at the bottom right of the proforma invoice to pay by card.
II.5. If the payment was made online (by bank transfer or using a bank card) at the time of completing the order, the products will be delivered by the courier company without collecting any value as a refund (i.e. no additional amounts are requested compared to the amounts paid in advance for the products and the transport cost).
II.6. No additional commission is charged for online payments.
II.7. No banking information is recorded, it being transmitted directly to the payment processor through an encrypted and secure connection.
III. Order registration
3.1. By placing an order on the website www.brotorheads.com/shop/, the customer expresses his agreement with the form of communication, by e-mail or telephone, through which Brotorheads carries out its commercial activity.
3.2. The product features and related prices are described for each product on the page from which the firm order is referred. Once the product is sent to the cart and the firm order is placed, the customer agrees to the product specifications and price.
3.3. There is a possibility that for certain products, the stock may run out, but if the ordered product is not available in stock, you will be notified as soon as possible (by phone or e-mail).
3.4. Depending on the new delivery date communicated, you can accept or cancel the order.
3.5. We reserve the right to change the quantity of products in the order or to cancel the order, depending on the available stock, but before making changes, we will contact you to notify you at the phone number or e-mail address included in the order, without any further obligation of either party to the other.
3.6. The notification sent to the customer after placing the order is for informational purposes only, and the contract is considered concluded upon receipt by the customer of the order dispatch notification via e-mail.
3.7. Orders placed without specifying the chassis series or for which compatibility with the specified car model is not checked (universal products, detailing products, universal spare parts, etc.) will not be confirmed by Brotorheads by phone and will be shipped as such, using the information in the order.
IV. Product delivery methods
IV.1. Product delivery will be made by express courier (chosen during the order placement process), as follows:
IV.2. We are not responsible for any delays that may occur after the package has been handed over to the courier company, but we are at your disposal with information regarding the status of the package delivery, as well as sending a message to the courier company to expedite the delivery.
IV.3. The maximum delivery time for packages is 21 business days (depending on the country of destination), from the moment you received confirmation of the order shipment, to your e-mail address, and orders placed during Saturdays and Sundays or public holidays will be processed on the first following business day.
IV.4. The order is shipped to the address indicated by you in the order. You are fully responsible for all import taxes related to the package that is the purpose of your order (VAT, customs duties, carrier commission with customs representation, etc.)
IV.5. Upon receipt of the package, please check the integrity of the packaging, as well as the tax invoice.
V. Product return policy
V.1. According to GEO 34/2014, you have 14 calendar days from receipt of the package to notify us by email at shop@brotorheads.com of your intention to return.
V.2. The right of withdrawal is, according to legal provisions, dedicated to individual consumers. Legal entities characterized as follows: SRL, SA, PFA, II, IF, etc. are not covered by GEO 34/2014 art. 9/1, and their return is optional. Thus, Brotorheads reserves the right to reject returns for this type of organization, especially if it does not comply with all the requirements listed below.
V.3. Product return conditions:
used, assembled, welded, painted products or those that show specific assembly traces cannot be returned;
products that were custom-made by one of Brotorheads' suppliers, especially for the customer's car, cannot be returned, as well as OE (original equipment) products, brought on special order cannot be returned;
for products purchased by external order – all products marked with a delivery time of 7 days or more, returns are not accepted, since they were ordered specifically for that customer;
automotive liquid products (engine oil, antifreeze, brake fluid, transmission oil, etc.) cannot be returned;
auto detailing and polish products must be returned unused, unopened or sealed, where applicable;
the notification for the return of the product must be made within 14 days from the moment of receiving the package;
the return of the products will be made in a packaging that does not allow the product to be damaged during transport;
we reserve the right to refuse damaged packages or products that show signs of wear;
returns will be made only together with the invoice received;
for products purchased at a discount, money cannot be refunded, only their equivalent in other products in our store.
V.4. In order to improve the quality of the products and services offered to our customers, we will be grateful if you communicate the reasons for the return.
V.5. All returned products will be replaced as long as the return conditions are met.
V.6. Return method:
V.6.1. Please notify us of your intention to return the product by sending an e-mail to shop@brotorheads.com, containing the following information: the name under which the order was placed, the order number, the product you wish to return;
V.6.2. The return will be sent to the address communicated by Brotorheads, within the return process;
V.6.3. The return will be sent by express courier, without refund. The value of the returned products will be returned exclusively to the bank account indicated by the Customer;
V.6.4. Payment for the return will be made by Brotorheads within a maximum of 14 days of receipt, to the bank account indicated on the return form, in accordance with the law in force.
V.6.5. For the return, the only cost you will incur will be the cost of transporting the product to our headquarters, without any other additional fees.
V.6.6. All returned products can be replaced with other products of your choice from our store (if they meet the return conditions).
V.6.7. Products that do not fall within the return policy of www.brotorheads.com/shop/ will not be considered and will be sent back to the buyer, the shipping cost being borne by him.
5.8. Payment for the return shipment
5.8.1. Payment by Brotorheads will be made in the following situations:
a. you received a product other than the one ordered;
b. you received products with a manufacturing defect;
c. you received products that are damaged.
5.8.2. Payment by the consumer will be made in any other situation that does not fall under point 5.8.1.
VI. Conditions for granting the guarantee
6.1. Following the purchase of a product from our website, we will ensure all the rights conferred by the legislation in force.
6.2. The way in which the consumer is provided with the guarantee is its replacement or, if this is not possible, the refund of the value. Brotorheads further offers the guarantee offered by the product manufacturer, for all items sold, both on the site and at points of sale. The products covered by the guarantee are guaranteed for defects that may occur during the guarantee period. The car parts must be mounted/installed in an authorized service in order to benefit from the guarantee.
6.3. The guarantee period for hidden defects and/or for the conformity of replacement products and original products runs from the date of their sale to the consumer. The period differs from product to product, as follows:
bulbs - 3 months;
windshield wipers - 6 months;
refurbished products (steering boxes, pumps, turbochargers, etc.) - 12 months;
batteries - 24 months;
batteries for school/taxi cars, commercial vehicles and motorcycles - 12 months;
tires - 2 years or until the tread reaches 1.6mm;
suspension and steering components and related parts for school/taxi cars - 3 months;
consumables and fluids, polishes, painting consumables - 0 months;
all other products - 24 months for EU customers, or 12 months for non-EU customers.
6.4. If the product is not in working order as guaranteed, the remedies will consist of the following order:
repair of the product by its manufacturer;
replacement of the product, if the product repair was unsuccessful;
refund of the purchase price, if the product cannot be replaced (no longer in production, no longer available in stock).
6.5. In no case will Brotorheads be obliged to pay any damages exceeding the purchase price of the product.
6.6. Defective auto parts during the warranty period will be returned accompanied by the following documents:
copy of invoice + tax receipt or courier receipt, as appropriate;
copy of the registration certificate or identity card of the vehicle whose product or material is subject to the warranty;
copy attesting to the validity of the periodic technical inspection;
proof of the installation of the parts in an authorized R.A.R. service (installation estimate) for the type of engine and the type of operation/work, as well as the related fiscal documents issued by the auto service unit (invoice, tax receipt) - obtained at the time of installation of the parts in an authorized R.A.R. service;
the note of non-conformity or hidden defect of the product/material issued by the car service unit - is obtained when the defect of the part is found, at any time during the warranty period. It is not necessary for the service to be the same service as the one that installed the part, but it is necessary to be authorized by the R.A.R.
6.7. Car polish/paint products that are defective during the warranty period will be returned accompanied by a copy of the invoice + tax receipt or courier receipt.
6.8. The warranty will be accepted by the manufacturer only after presenting all the documents mentioned in art. 6.6. Please keep these documents for the entire duration of the product warranty.
6.9. Ways to ensure the guarantee:
in the event of lack of conformity/hidden defects, found or occurring during the guarantee period of the product or material, the consumer may request its repair or replacement;
the suppliers and/or manufacturers with whom Brotorheads collaborates will analyze the customer's request and will repair or replace within 15 calendar days from the date on which they become aware of the product deficiencies, which are the subject of the guarantee request by them, the non-conforming products or materials, but no more than 30 days from the date of the request by Brotorheads
the guarantee request will be addressed directly to the supplier and/or manufacturer, following the instructions received from Brotorheads;
if for various reasons the supplier and/or manufacturer of the product cannot ensure the repair and/or replacement of the products within the above period, the consumer will be granted equivalent remedial measures, according to the law;
if the warranty claim is unfounded, the consumer will bear the costs related to the research/expertise of the product/material claimed as non-compliant or with hidden defects (transport costs, handling, diagnosis, expertise, dismantling, assembly, labor, packaging);
the products and materials replaced during the warranty period become the property of Brotorheads and will be handed over at the moment the warranty claim begins.
6.10. Situations in which the warranty is NOT granted or which lead to the product being out of warranty:
the product was purchased from another merchant and not from Brotorheads;
the consumer ordered the product incorrectly, did not provide us with identification data or transmitted it incorrectly;
the consumer requests the warranty outside the term mentioned above;
the product was used for other purposes or on other vehicles than those indicated by the manufacturer;
the products were not installed in an authorized R.A.R. auto service unit or were performed without appropriate tools or devices, without respecting the work technology established by the vehicle manufacturer or the product manufacturer;
the product was installed incorrectly or together with related parts that are worn, not in accordance with the manufacturer's specifications, defective or modified;
the wear or defect of the product is due to overload, improper maintenance or periodic adjustments, or unauthorized interventions on the product;
the product shows signs of impact, mechanical shocks, scratches, tears, cracks, bends, deformations that are not attributable to it or has suffered the action of extreme factors in the normal operating process;
the vehicle on which the product was installed has been in an accident or has suffered damage caused by external, atmospheric or other factors (thermal, mechanical, electrical shocks); situations caused by hazards, road conditions and driving the vehicle: impact with hard objects and accidental cuts, lateral or central friction with wear and heat dissipation effects, continued use with various sharp objects;
the vehicle on which the product was installed was used for purposes other than those intended by the manufacturer or was operated in inappropriate conditions: robot starts or by towing, exceeding the maximum permissible weight, sports competitions, rallies, drifts;
unauthorized installation on the vehicle of equipment other than those in the factory equipment that could affect the functionality of the claimed product;
damage or destruction of the product due to the consumer's fault due to transport, handling, storage, preservation, use, improper operation, or contact with aggressive chemical products or proximity to heat sources;
the product's serial/marking/constructive or identification code has been erased or it has artisanal markings or stampings;
dismantling of the products into component parts or subassemblies, or damage to the seals applied by the manufacturer, where applicable;
the part has failed due to other causes in the system of which it is part (for example, the warranty required for a DPF filter that has become clogged due to an EGR valve that is not working correctly);
product failure due to the presence of foreign bodies, dust, dirt in their operating areas (lubrication system, hydraulics, intake, etc.);
failure to comply with the interval and schedule of technical inspections established by the vehicle manufacturer.
VII. Right of withdrawal
The customer may exercise his right of withdrawal in accordance with the provisions of Government Ordinance 34/2014 on consumer rights in contracts concluded with professionals.
VIII. Disputes
By using the website www.brotorheads.com/shop/, the user agrees to the above “Terms and Conditions”. Any dispute of any kind that may arise between the user and Brotorheads or its partners will be resolved amicably. If this is not possible, the conflict will be resolved in court, in accordance with the Romanian laws in force.
IX. Final provisions
9.1. Brotorheads reserves the right to make any changes to these provisions, as well as any changes to the website www.brotorheads.com/shop/ and its structure, including changes that may affect the website, without prior notice.
9.2. Brotorheads cannot be held responsible for any errors that may occur on the site for any reason, including due to changes, settings, etc., that are not made by the site administrator and is not responsible for the content, quality or nature of other sites that are accessed through links on the www.brotorheads.com/shop/ site, regardless of the nature of these links.
9.3. For those sites, the responsibility lies entirely with their owners. Brotorheads reserves the right to insert advertising banners of any kind on any page of the www.brotorheads.com/shop/ site, in compliance with the legislation in force. Exceptions are pages where member companies or their offers are presented and where no banners of a competitive nature will be inserted.
9.4. It is prohibited to copy or reproduce the information contained on the site without the written approval of the authors.
